Effective September 1, 2015, the Texas Department of Aging and Disability Services (DADS) no longer requires contractors of emergency response services under Title XX of the Social Security Act to have the following:

a license as a personal emergency response system provider issued by the Department of State Health Services in accordance with Title 25, Texas Administrative Code (TAC) Chapter 140, Subchapter B (relating to Personal Emergency Response System Providers); or
-
a license as an alarm systems company issued by the Texas Private Security Board in accordance with the Texas Occupations Code, Chapter 1702.
This change conforms with the repeal of Health and Safety Code, Chapter 781 regarding personal emergency response systems, enacted by Senate Bill 202, 84th Texas Legislature, Regular Session, 2015).
DADS rule at 40 TAC ยง49.205(a)(17) will be repealed to remove the licensure requirements for contractors of Title XX emergency response services contractors.
