Public Hearing and Notice
HHSC will hold a hearing on Thursday, December 5, 2013, at 8:30 a.m. to receive public comment on proposed payment rates for the AL/RC services under the CBA program, CBA Personal Care III services, and RC program. The hearing will be held in the Public Hearing Room, Brown-Heatly Building, located at 4900 North Lamar, Austin.
HHSC intends to submit to CMS a request to amend the HSC waiver. Among the changes: establish a new reserved capacity group for individuals who’ve moved from a SSLC to a community ICF/ID and choose to enroll in HCS waiver for up to three years after moving from the SSLC; and update the mandatory participation requirements to remove the reference to an individual’s behavior. HHSC also intends to add employment assistance and cognitive rehabilitation therapy, including the CDS option, and other changes. See the Texas Register for more information.
Proposed Rules
The Texas Medical Board proposed to amend §183.11, Complaint Procedure Notification, to change an incorrect citation to Chapter 187 in the rule text to the correct citation, Chapter 178 of this title. For more information, see the Texas Register.
Adopted Rules
HHSC adopted amendment to §354.1005, Unauthorized Charges, and §354.1131, Payments to Eligible Providers, to update obsolete TAC citations, update agency and program names, clarify the use of inconsistent terminology, and align the rules with HHSC’s preferred drafting style. The Board of Nursing adopted an amendment to §216.3, Requirements, which requires Advanced Practice Registered Nurses (APRN) who prescribe controlled substances to complete an additional three hours of continuing education related to prescribing controlled substances each biennium.
The board also adopted the repeal of Chapter 222, §§222.1 – 222.12, Advanced Practice Registered Nurses with Prescriptive Authority and new Chapter 222, §§222.1 – 222.10, Advanced Practice Registered Nurses with Prescriptive Authority. See the Texas Register for more information about both entries.
