The following information was obtained from the June 28 issue of the Texas Register.
Public Hearings
HHSC will hold a hearing on Monday, July 15, 2013, at 8:30 a.m. to receive public comment on proposed interim per diem Medicaid reimbursement rates for small and large, DADS-operated ICF/IID.
HHSC will hold a hearing the same day at 10 a.m. receive public comment on proposed payment rate adjustments for the TxHmL waiver program.
HHSC will hold a hearing on the same day at 1 p.m. to receive public comment on proposed rates for Levels 26 through 35 under the Attendant Compensation Rate Enhancement in the CBA – HCS; CBA – AL/RC; CLASS; DAHS, DBMD; PHC; and RC.
HHSC will a hearing on the same day at 3 p.m. to receive public comment on the proposed rate for the Truman W. Smith Children’s Care Center.
The hearing for NF and Hospice-NF Medicaid payment rates will be held at the same time.
HHSC will hold a hearing on Tuesday, July 16, 2013, at 8:30 a.m. to receive public comment on proposed rates for employment assistance (EA) for CBA, CLASS, HCS, and MDCP waiver programs; for supported employment (SE) in the CBA and MDCP waiver programs; for consumer-directed services SE and EA in the DBMD, CLASS and HCS waiver programs; and for CDS nursing services in the HCS program.
HHSC will hold a hearing on the same day at 10:30 a.m. to receive public comment on proposed statewide rates for the 24-Hour Residential Child Care (24 RCC) program and rates under foster care redesign for Single Source Continuum Contractors providing services in the 24 RCC program operated by the DFPS.
HHSC will hold a hearing on the same day at 1 p.m. to receive public comment on proposed payment rates for Community Living Supports – Bachelor’s Level, Community Living Supports – Master’s Level, Family Supports Services, Paraprofessional Services, the Pre-Engagement Fee, and In-home Respite, in the Youth Empowerment Services waiver program operated by the DSHS. In addition, rates are proposed for two services that are being added to the YES waiver, SE and EA.
All hearings will be held in the Public Hearing Room of the John H. Winters Building, located at 701 West 51st Street, Austin, Texas.
Proposed Rules
HHSC proposed to amend §352.17, Out-of-State Medicaid Provider Eligibility, which would add new subsection (h) to allow a laboratory to be enrolled as an in-state Medicaid provider, regardless of where the service is performed, with qualifications. For more information, see the Texas Register.
HHSC proposed to amend §§353.903, 353.905, 353.907, and 353.913, Outpatient Pharmacy Services in the Medicaid managed care program, to comply with SB106, which requires Medicaid and CHIP MCOs to be transparent about disclosing to pharmacies how they set their maximum allowable costs for drugs. HHSC proposed to amend §§354.1601, 354.1602, 354.1611, 354.1613, 354.1621, 354.1622, 354.1632, 354.1633, and 354.1634, the Texas Healthcare Transformation and Quality Improvement Program, and new §354.1635, RHP Plan Modification. Among other things, the changes would match Program Funding and Mechanics Protocol as it stood in October 2012. For more information, see the Texas Register.
HHSC proposed to amend §355.112, Attendant Compensation Rate Enhancement, to incorporate changes to cost reporting requirements in §355.112 proposed in the April 26, 2013, issue of the Texas Register (38 TexReg 2582) and subsequently withdrawn. See the Texas Register for more information.
- On DADS’ Behalf
HHSC proposed new §49.71, Contractors with Personal Attendant Employees; §49.72, Financial Management Services Agencies; and §49.73, Enforcement of Personal Attendant Wages, in Chapter 49, Contracting for Community Care Services. The new sections would require certain community services contractors to pay personal attendants base wages of at least a specified amount. For more information, see the Texas Register.
Withdrawn Rules
HHSC withdrew the proposed amendment to §355.112, which appeared in the April 26, 2013, issue of the Texas Register (38 TexReg 2582).
