Public Hearing and Notice
HHSC will hold a public hearing on proposed Medicaid payment rates for anesthesiologist assistants on Wednesday, May 15, 2013, at 1:30 p.m. in the HHSC Brown Heatly Building on 4900 North Lamar, Austin. HHSC intends to submit to CMS a request to renew the HCS waiver program. See the Texas Register for more information.
Proposed Rules
HHSC proposed to amend §354.1003, Time Limits for Submitted Claims, which would allow enrolled Medicaid providers under the Blind Children’s Vocational Discovery and Development Program to submit Medicaid claims for services rendered under the program, for which certification of the expenditures of state or local funds is required, within 365 days from the date of service.
HHSC proposed to amend §355.112, Attendant Compensation Rate Enhancement, which would reduce reporting challenges for HCS, TxHmL, and ICF/IID providers contracting with non-related parties to provide day habilitation by allowing them to report their total contracted day habilitation costs on a single cost report item.
Finally, HHSC proposed to amend §355.7103, Rate-Setting Methodology for 24-Hour Residential Child-Care Reimbursements, which would revise subsection (f)(4) to replace language specifying when a 24 RCC provider is excused from submitting a cost report with a reference to the uniform excusal rules at §355.105. Adopted Rules
HHSC adopted amendments to §355.8085, Reimbursement Methodology for Physicians and other Practitioners, which implement the federal requirements for states to set Medicaid rates equal to the 2013-2014 Medicare rates for certain evaluation and management services and vaccine administration services provided by physicians specializing in family medicine, general internal medicine, or pediatric medicine. - On DADS’ Behalf
HHSC adopted new §98.105, Administrative Penalties, in Chapter 98, Adult Day Care and Day Activity and Health Services Requirements, which allows DADS to impose an administrative penalty on an adult day care facility if the facility violates a rule, standard, or order under THRC Chapter 103 or 40 TAC Chapter 98, Adult Day Care and Day Activity and Health Services Requirements, or the term of a license issued under Chapter 98.
