Public Hearings
HHSC will hold a public hearing on August 28, 2012, to receive comments on the proposed amendments to §354.1252 and new §354.1253 under Texas Administrative Code, Title 1, Chapter 354, Subchapter A, Division 16 concerning Certified Nurse Midwife Services: Conditions for Participation; and Licensed Midwife: Conditions for Participation. The hearing will take place from 10-11 a.m.
On the same day, HHSC will hold a public hearing to receive comments on the proposed amendments to §354.1261 and §354.1262 under Texas Administrative Code, Title 1, Chapter 354, Subchapter A, Division 17, concerning Birthing Center Services; Benefits and Limitations, and Conditions for Participation. This hearing will take place from 9-10 a.m. Both hearings will be held in the Lone Star Conference Room. See the Texas Register for more information.

HHSC proposed to amend §355.105, General Reporting and Documentation Requirements, Methods, and Procedures; §355.112, Attendant Compensation Rate Enhancement; §355.306, Cost Finding Methodology; §355.308, Direct Care Staff Rate Component; §355.503, Reimbursement Methodology for the Community-Based Alternatives Waiver Program and the Integrated Care Management-Home and Community Support Services and Assisted Living/Residential Care Programs; §355.505, Reimbursement Methodology for the Community Living Assistance and Support Services Waiver Program; §355.507, Reimbursement Methodology for the Medically Dependent Children Program; §355.509, Reimbursement Methodology for Residential Care; §355.510, Reimbursement Methodology for Emergency Response Services; §355.511, Reimbursement Methodology for Home-Delivered Meals; §355.513, Reimbursement Methodology for the Deaf-Blind with Multiple Disabilities Waiver Program; §355.5902, Reimbursement Methodology for Primary Home Care; and §355.6907, Reimbursement Methodology for Day Activity and Health Services.
The changes would create rules for how some providers might be automatically excused from submitting a cost report, add DAHS to the CBA and MDCP waiver programs, delete obsolete language to reflect current agency practice, and update references to legacy HHS. Adopted Rules
HHSC adopted new §355.458, Supplemental Payments to Non-state Government-owned ICFs/IID. Under this rule, non-state government-owned ICFs/IID may apply to receive supplemental payments determined in according to Medicaid UPL provisions codified at Title 42 CFR §447.272.
