The following information was obtained from in the July 6 issue of the Texas Register.
Public Hearings
On July 23, 2012, at 1:30 p.m., HHSC will hold a public hearing to receive comments on proposed amendments to the administrative rule at 1 TAC §355.8052, which governs the payment methodology for Medicaid inpatient hospital reimbursement.
On August 15, 2012, at 1:30 p.m., HHSC will hold a public hearing to receive comment on proposed Medicaid payment rates for Computed Tomography and Magnetic Resonance Imaging, Hearing Devices and Services, and Medicaid Biennial Calendar Fee Review.
Both hearings will be held in the Long Star Conference Room. See the Texas Register for more information.
Proposed Rules
- On DADS’ behalf
HHSC proposed to amend 40 TAC §19.201, Criteria for Licensing; §19.208, Renewal Procedures and Qualifications; §19.209, Exclusion from Licensure; §19.210, Change of Ownership License; §19.214, Criteria for Denying a License or Renewal of a License; and §19.216, License Fees, in Chapter 19, Nursing Facility Requirements for Licensure and Medicaid Certification, which would authorize DADS to require an NF license applicant to disclose complete compliance history in each state or other jurisdiction and to extend the maximum amount of time DADS may exclude a person from eligibility for a license or renewal from 10 years to the person’s lifetime or existence. HHSC proposed to repeal several sections of Chapter 72, Memorandum of Understanding with Other State Agencies, including §72.102, §72.104, §72.401, and §72.801. The repeals would delete unnecessary rules in which the former Texas Department of Human Services, the former Texas Department of Mental Health and Mental Retardation, or both, were parties. HHSC proposed to repeal Subchapter B, Interagency Agreements, including §100.51, Purpose; §100.52, Application; §100.53, Definitions; and §100.54, an MOU regarding provision, regulation, and funding of services in hospitals and long-term care facilities. The repeals would delete unnecessary rules in which the former Texas Department of Human Services, the former Texas Department of Mental Health and Mental Retardation, or both, were parties. Adopted Rules
HHSC adopted new §354.1451, Medicaid Recovery Audit Contractor Program, which establishes a program in which HHSC contracts with one or more recovery audit contractors who will identify underpayments and overpayments under the Medicaid program and recover the overpayments for services provided under the Medicaid State Plan or a waiver of the Medicaid State Plan.
