Public Hearing and Notices
HHSC will hold a public hearing on September 16, 2011, at 9 a.m. to receive public comment on the proposed interim per diem Medicaid reimbursement rates for small and large, state-operated ICFs/MR in the Lone Star Conference Room of the Braker Center, Building H, located at 11209 Metric Boulevard, Austin.
HHSC intends to submit to CMS a request to amend the CLASS waiver program, under the authority of §1915(c) of the Social Security Act, which would to establish service limits for some services and set new limits for services that currently have limits.
HHSC intends to submit to CMS a request to amend the HCS waiver program, which would establish service limits for some services and set new limits for services that currently have limits.
HHSC intends to submit to CMS a request to amend the CBA waiver program, which would establish service limits for some services and set new limits for services that currently have limits.
HHSC intends to submit to CMS a request to amend the MDCP waiver, which would establish service limits for some services and set new limits for services that currently have limits.
HHSC published a public notice about submitting a Medicaid waiver request in the May 27, 2011, issue of the Texas Register (36 TexReg 3355) and another notice in the August 26, 2011, issue of the Texas Register (36 TexReg 5455). The notices contained an error and should have read in part:
Finally, HHSC intends to submit to CMS one or more waiver requests under sections 1115 and/or 1915 of the Social Security Act related to the transition of all current STAR and STAR+PLUS areas, the inclusion of 28 additional counties effective September 1, 2011, and phase-in of more counties effective March 1, 2012. The counties are listed in the table below.
The waiver request would allow expansion of Medicaid managed care throughout Texas by maintaining historic local contributions to Medicaid for hospitals currently receiving upper payment limit payments. If approved, acute care benefits will be administered statewide through managed care. Other Medicaid services and long-term services and supports will be available in specific counties.

Proposed Rules
HHSC proposes new §355.7105, Reimbursement Methodology for Supervised Independent Living (SIL), which describes the rate methodology for the SIL service. See the Texas Register for details.
Adopted Rules
HHSC adopts the repeals of §355.113, Reimbursement for Developmental Rehabilitation Therapy Services for Infants and Toddlers with Disabilities or Developmental Delays; §§355.8423 – 355.8426, concerning the cost determination process for the Early Childhood Intervention (ECI) program; and §§355.9001 – 355.9010 and §§355.9012 – 355.9014, concerning the reimbursement methodology for ECI case management services; and adopts the amendments to §355.8421, General Reimbursement Information, and §355.8422, Cost Reporting Procedures.
The changes consolidate the reimbursement methodology for ECI program services related to case management and rehabilitative services into two rules and incorporate references to the cost determination process rules in Subchapter A. For more information, see the Texas Register.

HHSC adopted amendments to §§1.301 – 1.303, 1.305, 1.307 – 1.310, and 1.312, concerning purpose, application, definitions, process to establish a new community center, modifying a community center’s current plan, dissolution or merger of community centers, appointment of manager or management team, standards of administration for boards of trustees, and fiscal controls; and the repeal of §§1.304, 1.306, and 1.313 – 1.316, concerning philosophy, updating a community centers current plan, determination of salaries of community center employees, exhibits, references, and distribution, in Chapter 1, State Mental Retardation Authority Responsibilities.
The amendments and repeal revise the process for reviewing and approving a community center’s plan to reflect changes in agency names and elimination of the Texas Mental Health and Mental Retardation Board, in accordance with the 2004 reorganization of the health and human service agencies.
