DADS released two provider and three information letters:
All large ICFs/MR:
DADS reminds these providers that locks for exit doors that are opened by keys can only be used in certain circumstances. The National Fire Protection Association 101 Life Safety Code Standard, 2000 Edition requires that “exit access is arranged so that exits are readily accessible at all times in accordance with section 7.1, 18/19.2.1.” (Letter)
Licensed ICFs/MR:
DADS provided guidance for reporting and investigating suspected A/N/E in licensed ICFs/MR. Effective June 1, 2010, the guidelines supersede those indicated in Provider Letter 08-05, dated April 21, 2008, for licensed ICFs/MR. An excerpt:
Reporting Alleged A/N/E to DFPS – DADS adopted rules at Texas Administrative Code (TAC), Title 40, Part 1, Chapter 90, Subchapter G, §90.212, effective June 1, 2010, require:
1. “A person, including a facility owner or employee, who has cause to believe that a resident of a facility has been or is being subjected to physical abuse, sexual abuse, sexual exploitation, verbal or emotional abuse, neglect, or exploitation, as those terms are defined in Chapter 711 of this title (relating to Investigations in DADS Mental Retardation and DSHS Mental Health Facilities and Related Programs), by a person other than a resident of the facility, must report the alleged abuse, neglect, or exploitation to the Texas Department of Family and Protective Services, as required by Chapter 711 of this title, by calling 1-800-647-7418.
HCS:
DADS notified providers that as part of the DADS’s Settlement Agreement with the Department of Justice related to state supported living centers (SSLCs), effective June 26, 2009, each SSLC is responsible for conducting post-move monitoring visits following an individual’s move from the SSLC to the community. Effective the date of this letter, DADS will allow an HCS Program provider to be paid for day habilitation provided to an individual who is at least 18, but under 22, if the individual is not required to attend school because he’s voluntarily left school, or he’s not eligible for school because he graduated with a high school diploma.
