DADS issued three provider and three information letters last week:
DADS notified ICFs/MR providers of amendments to Section 252.122 of the Health and Safety Code, Section 261.109 of the Family Code, Section 48.052 of the Human Resources Code, and Section 22.04 of the Penal Code, which added new language. Example (new language in bold):
“Notification of duty to report abuse, neglect and exploitation. Each facility shall require each employee of the facility, as a condition of employment with the facility, to sign a statement that the employee realizes that the employee may be criminally liable for failure to report abuse, neglect or exploitation.” (Letter)

See changes to the code that affect Adult Day Care Facilities, Assisted Living Facilities, HCSSAs, ICFs/MR, and NFs and apply applies only to the initial employment of a person by a facility or agency regulated by Chapter 250, Health and Safety Code, on or after the effective date of HB 2191 (9/1/09): Letter
For CLASS providers and CDSAs: DADS renewed the CLASS Medicaid Waiver, effective September 1, 2009, through August 31, 2014. The changes are outlined in the three-page letter.
To HCS, TxHmL, MRAs, and CDSAs: DADS notified all HCS and TxHmL program providers, MRA staff, and CDSAs that initiation of the new nursing categories and new rates for specialized therapies for both the HCS and TxHmL Programs has been delayed, rescheduled to September 14, 2009, and retroactive to September 1, 2009.
