The Department of Aging and Disability Services (DADS) issued one provider and five information letters:
- New Franchise Tax Report Requirements
DADS sent a provider letter to Adult Day Care Facilities, Assisted Living Facilities, Home and Community Support Services Agencies, Intermediate Care Facilities for Persons With Mental Retardation or Related Conditions, and Nursing Facilities to inform them about current license application instructions. - Integrated Care Management (ICM) 1915(c) Waiver and Medical Necessity/Level of Care Assessments
DADS informed ICM Home and Community Support Services Agencies that HHSC and Evercare have agreed to end the contract for the ICM program. Download the three-page letter for details.
- Availability of Facility Inventory, Vacancy and Evacuation Status (FIVES) for Home and Community-based Services (HSC) Providers
DADS sent a letter to HCS Program providers to announce the addition of the FIVES system to HCS providers. DADS created FIVES so providers can help one another during emergencies that may require mass evacuations. Download the five-page letter for more information.
- Request for Waiver of Requirement to Deliver Meals Fewer than Five Days a Week (replaces IL No. 08-116)
DADS sent a letter to Title XIX and Title XX Home Delivered Meals providers to describe the process they must follow to request a waiver of the program requirement to deliver a minimum of five hot meals per week. Form 2027 is located at this web page. Download the two-page letter.
- Criminal History Checks
DADS informed Consumer Directed Services Agencies that they’re no longer able to use the secure website through the Texas Department of Public Safety to conduct criminal history checks for employment applicants or potential designated representatives on behalf of individuals using the Consumer Directed Services option, effective immediately. - Revisions to 40 Texas Administrative Code, Part 1, §47, Contracting to Provide Primary Home Care (PHC) Providers
DADS has revised PHC provider rules in 40 TAC §47, “Contracting to Provide Primary Home Care,” effective June 1, 2009. The rules will be implemented on July 1, 2009. An excerpt:
The term “negotiated referral†has been changed to “expedited referralâ€. An “expedited referral†is defined as “An oral request from a case manager to a provider when the case manager determines that an individual’s needs require that pre-initiation activities be completed in less than 14 days. The completion date is negotiated between the case manager and provider.†The provider contacts the case manager to initiate a start-of-care date and may begin services prior to submitting the Practitioner’s Statement with the case manager’s oral approval. See §47.3, §47.43(b)(1), and §4745(a)(3)(B).
