The Texas Department of Aging and Disability Services (DADS) released five information letters and one provider letter:
- Respite and Adjunct Support Services provided by Registered Nurses (RNs) and Licensed Vocational Nurses (LVNs) through the Consumer Directed Services (CDS) Option in Medically Dependent Children Program (MDCP)
DADS informed providers that MDCP Respite and Adjunct Support Services provided by RNs and LVNs is available through the CDS option, effective February 10, 2009. Download the three-page letter for details.
- Notifying Individuals of Rights and Responsibilities and of Procedures for Filing Complaints
DADS informed providers of Title XIX and Title XX Home Delivered Meals that they are required by Texas Administrative Code (TAC), Title 40, §49.18, concerning Client Rights and Responsibilities, to notify an individual or authorized representative of the individual’s rights and responsibilities under Texas Human Resources Code, Chapter 102, Rights of the Elderly, and procedures for filing a complaint, including the name, title, and phone number of the person to whom a verbal complaint may be made. - Guidelines for Reporting Incidents
DADS informed Non-licensed Intermediate Care Facilities for Persons with Mental Retardation or a Related Condition that they must report all allegations of abuse, neglect or exploitation for investigation within one hour to the Texas Department of Family and Protective Services at 1-800-647-7418. - Required Forms
In a letter to Adult Foster Care (AFC) providers, DADS said it began conducting monitoring reviews of AFC providers and noticed that several forms required under 40 TAC, Chapter 48, §48.8907, have not been in case files. DADS reminds these providers to file the correct forms. Download the letter for more information.
- Clarification of Purpose Codes E and M (replaces IL 2008-181)
In a letter to Nursing Facility providers, DADS clarified the Purpose Code E and Purpose Code M and shared several questions that require special attention. Download the four-page letter for details.
- Documentation and Moving Expenses
From a DADS letter to Transition Assistance Services (TAS) providers:
TAC, Title 40, §62.41(d) requires a TAS provider to ‘maintain service delivery documentation and purchase receipts” in the record of an individual for whom the provider purchases household items. A receipt must include only items for which the provider has received authorization from the Texas Department of Aging and Disability Services (DADS) on Form 8604, TAS Assessment and Authorization…DADS has revised Form 8604, effective February 2009, to include a signature line for the individual or individual’s representative…
