The Texas Department of Aging and Disability Services (DADS) has issued one provider and three information letters:
- DADS Time Frames for Submission of a Plan of Correction (PoC) for Licensure Violations and Assessing an Administrative Penalty When a Facility Fails to Submit a Timely PoC for Licensure Violations
DADS informed Intermediate Care Facilities for Persons with Mental Retardation or a Related Condition (ICFs/MR) that it adopted a rule to allow DADS to assess an administrative penalty against a licensed ICF/MR if it does not submit a PoC within the longer time period of 10 working days after receiving the final DADS Form 3724. - Communication to all Foster/Companion Care Providers Regarding the Redistribution of the Home and Community-based Services (HCS) Monthly Administration and Operations Fee
DADS requires HCS Program providers to distribute copies of the attached letter from the Texas Health and Human Services Commission (HHSC) to all foster/companion providers contracting with or employed by the program provider so that foster/companion care providers are accurately informed of the upcoming changes to HCS rates. - Client Abuse and Neglect Reporting System (CANRS)
DADS informed non-state operated ICFs/MR that it’s making CANRS available so that more comprehensive pre-employment screenings of applicants and screenings of current employees can be conducted to determine any confirmed allegations of abuse, neglect or exploitation against the person while employed at Texas schools, hospitals, and centers. - Communication Regarding the Redistribution of the HCS Monthly Administration and Operations Fee
HHSC proposes to amend Reimbursement Methodology for HCS to the Medical Care Advisory Committee on March 12, 2009, and to the DADS Council on March 18, 2009. The rule would eliminate the monthly Administration and Operations Fee and replace it with a methodology that allocates administration and operations expenses across all HCS services for rate setting purposes.
