The Texas Department of Aging and Disability Services (DADS) released eight information letters:
- Effective December 1, 2008 — Change in the Texas Administrative Code (TAC), Title 40, Chapter 44, Consumer Managed Personal Attendant Services (CMPAS), Relating to the Co-payment Chart
DADS notified CMPAS providers about a TAC change, effective December 1, 2008. The change removes the previously attached co-payment chart from 40 TAC, Chapter 44 and replaces it with a statement to locate the co-payment chart in the Community Care for the Aged and Disabled provider manual under Appendix XXXV, Co-payment Schedule for CMPAS. - Change of Ownership and Contract Assignment Requirements
DADS informed Adult Day Care providers contracted to provide care to Community Care Services of a change in ownership and contract assignment requirements. From the letter:
Currently the Texas Department of Aging and Disability Services (DADS) requires that when there is a change of ownership (CHOW) for the license required to obtain a community services contract, the HCSSA or ADC must also request assignment of any contract under that license. DADS Community Services Contracts (CSC) Unit staff must review and approve the assignment and set the effective date of the assignment. The purpose of this letter is to remind HCSSAs and ADC providers about contract assignment requirements and procedures. For the purpose of this letter, a “new HCSSA†or “new provider†is a HCSSA or ADC provider with an initial license, whether or not the initial license results from a CHOW.

- Cost Information Requested by January 22, 2009, for LTC Services Provided to NonMedicaid Evacuees during Hurricane Ike
DADS informed Nursing Facility, Intermediate Care Facility for Persons with Mental Retardation, and Home and Community Support Service (HCS) agencies that it’s collecting information on hurricane-related costs incurred since September 7, 2008, by Long Term Care providers that accepted nonMedicaid eligible evacuees. - Cost Information Requested by January 22, 2009, for Transportation Services Provided to DADS Clients during Hurricane Ike
DADS informed long term care providers that it is collecting information on hurricane-related costs incurred since September 7, 2008, including costs for non-reimbursed hurricane-related transportation provided for DADS clients. Download the two-page letter for more information.
- Rate Changes for Cost of Living Adjustments
The Texas Health and Human Services Commission (HHSC) approved rate changes for a number of providers, including Community Care for the Aged, Community Based Alternatives, Assisted Living/Residential Car, and Consolidated Waiver Program providers, effective January 1, 2009. - Termination of Provisionally Certified HCS Program Provider Agreements (replaces IL 2005-39)
DADS clarified for providers the process by which an HCS Program Provider Agreement is terminated by DADS. It “may terminate the program provider agreement of a provisionally certified program provider that is not certified within 540 calendar days after the effective date of the program provider agreement.” See the letter for more information.
- Rule §355.509 Reimbursement Methodology for Residential Care
HHSC adopted an amendment to Title 1 of the Texas Administrative Code (TAC) §355.509 relating to Reimbursement Methodology for Residential Care, effective January 25, 2009. Residential care providers can download the letter here.
- Provider Requirements for Reporting the Death of an Individual Receiving HCS or Texas Home Living (TxHmL) Services
