For Nursing and Assisted Living Facilities, and Intermediate Care Facilities Serving Persons with Mental Retardation or a Related Condition
The Texas Department for Aging and Disability Services (DADS) released a letter, dated November 24, alerting providers to guidelines for amelioration of administrative penalties. The letter explains what amelioration is (allowing “a facility, instead of paying fines for violations, to invest monies back into the facility”), legal authority, what DADS will look for in amelioration plans, how DADS will monitor the plans, and much more.

For ICF-MR/RCs
In a letter dated December 5, DADS informed ICF-MR/RC providers that it has entered into a Memorandum of Agreement with the Texas Department of State Health Services to conduct monitoring of ICF-MR/RC trust fund accounts. For more information, download the letter here.
For Nursing Facilities
In a letter dated December 4, DADS alerted nursing facilities to policy changes regarding the STAR+PLUS program. Nursing facilities serving clients under this program are required to bill clients through the Texas Medicaid & Healthcare Partnership. The STAR+PLUS program will no longer be responsible for paying nursing facility providers for nursing facility services. You may download the letter here.
