Administration Strengthens Job Protections for Returning Military — U. S. Labor Secretary Elaine Chao and Attorney General John Ashcroft have signed a plan to strengthen and streamline enforcement of the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA). The Administration has delegated the Department of Labor’s enforcement responsibilities under the USERRA to the Veteran’s Employment Solicitor, and the Attorney General’s enforcement responsibilities to the Civil Rights Division of the Department of Justice and the U.S. Attorney’s office.
New Department of Labor Forms Available — Pension and welfare benefit plans are generally required to file annual return reports by completing the DOL 5500 form (which is updated every year). The DOL requires these forms be filed for compliance and research, and form 5500 is part of the ERISA reporting and disclosure rules. Flu Shots Shortage — About 60% of employers plan to provide flu shots to employees this year, according to a survey by the Society for Human Resource Management. Due to the shortage, the Centers for Disease Control and Prevention have dictated that shots only go to people “at risk.” That includes children 6-23 months, adults 65 and older, people 2-64 years with underlying chronic medical conditions, pregnant women, nursing-home residents, children on chronic aspirin therapy, healthcare workers and out-of-home caregivers.
