The purpose of this information letter is to inform Texas Home Living (TxHmL) program providers and
local authorities the two service categories for the TxHmL Program: the Community Living Service
Category and the Technical and Professional Supports Service Category, were discontinued effective
September 1, 2014. The TxHmL Program rules at Texas Administrative Code (TAC), Title 40, Chapter 9,
Subchapter N, have been amended to reflect the deletion of all references to and requirements regarding
these service categories, including the repeal of Section 9.559 which required the service coordinator to
request an increase to a service category limit under certain circumstances. The rule amendments were
effective September 1, 2014. In addition, the Application for a ยง1915(c) Home and Community-Based
Services Waiver commonly referred to as the TxHmL Program waiver application was amended to remove
the two service categories.
For an Individual Plan of Care (IPC) with an effective date of September 1, 2014 or later, the service
coordinator will no longer need to fax DADS Form 8628, Request to Increase Service Category Limits
Worksheet to DADS. However, due to functional limitations of the DADS data system, when entering an
IPC with an effective date of August 31, 2014 or earlier and exceeds a previous service category limit, the
service coordinator must continue to fax Form 8628 to DADS. Upon receipt of the form, DADS will
authorize the increase to the service category limit thereby authorizing the IPC in the DADS data system.
As a reminder, in accordance with 40 TAC, Chapter 9, Subchapter N, Section 9.558(d), DADS does not
approve an IPC having a total cost that exceeds $17,000, the combined cost limit specified in Appendix C
of the TxHmL Program waiver application.
