Public Hearings and Notices
HHSC will hold a public hearing on proposed Medicaid payment rates for the following: physician-administered drug – Xolair, PASRR Level II Evaluation, Certified Respiratory Care Practitioners through the Comprehensive Care Program, Diabetic Equipment and Supplies, EPSDT – Dental Services, hearing aids, incontinence supplies, Medicaid Biennial Calendar Fee Review, Mobility Aids, new orthoses benefits, some Durable Medical Equipment, Prosthetics, Orthotics, and Supplies added as Medicaid benefits during the 2013 Annual Healthcare Common Procedure Coding System update, and 2013 Healthcare Common Procedure Coding System Quarterly update for Durable Medical Equipment, Prosthetics, Orthotics, and Supplies Type of Service 9 -J-L.
The hearing will be held on Wednesday, May 15, 2013, at 1:30 p.m. in the HHSC Public Hearing Room, Brown Heatly Building, located at 4900 North Lamar, Austin. See the Texas Register for more information.
HHSC intends to submit to CMS a request to amend the Youth Empowerment Services waiver, which would remove the current restriction that prohibits waiver participants from receiving State Plan Services through the Texas Healthcare Transformation Quality Improvement Program 1115 waiver, which include the STAR and STAR+PLUS programs.
HHSC intends to submit an amendment to the Texas State Plan for Medical Assistance, which would update the fee schedules in the current state plan by modifying fees for existing services. For more information about both entries, see the Texas Register.
Proposed Rules
HHSC proposed to amend §§354.1061, 354.1071, and 354.1101, Additional Claim Information Requirements. The changes would clarify claim information requirements related to diagnosis codes for physician and physician assistant services, hospital services, and podiatry services. HHSC proposed to repeal §355.451, Definitions and General Reimbursement Information; §355.452, Cost Reporting Procedures; §355.453, Allowable and Unallowable Costs; §355.703, Basic Objectives and Criteria for Review of Cost Reports; §355.704, Determination of Inflation Indices; §355.705, Notification; §355.706, Adjusting Reimbursement; §355.708, Allowable and Unallowable Costs; and §355.709, Revenues. HHSC proposed to repeal §§379.207 and 379.405 – 379.407, Shelter Centers; §§379.1101 – 379.1103 and 379.1312 – 379.1321, Special Nonresidential Projects; and §§379.1606, 379.1805, 379.1806, and 379.2109 – 379.2113, Nonresidential Centers.
HHSC proposed new §§379.405 – 379.408, Shelter Centers; §§379.1101 – 379.1105 and 379.1312 – 379.1323, Special Nonresidential Projects; and §§379.1805 – 379.1807 and 379.2109 – 379.2114, Nonresidential Centers.
The changes would clarify, update, or strengthen rules governing the Family Violence Program. For more information, see the Texas Register.

HHSC proposed to amend §§9.203, 9.207, 9.208, 9.221, 9.251, 9.252, 9.256, 9.266, And 9.268, Definitions, Certification and Licensure, Provider Agreement, Durable Medical Equipment, Protecting Individuals’ Personal Funds, Notice Regarding Personal Funds, Program Provider-Managed Personal Funds, Department Review of State Survey Agency Findings, and Termination of Provider Agreement; new §§9.225, 9.262, 9.263, and 9.270, Reporting Incidents to DADS, Trust Fund Monitoring and Audits, Informal Review And Administrative Hearing, and Suspension Of Payments; and The Repeal Of §9.216, Concerning Renewal of Provider Agreement, and §9.225, Reporting Abuse, Neglect, and Injuries of Unknown Source, in Chapter 9, Intellectual Disability Services–Medicaid State Operating Agency Responsibilities.
Among other things, the proposed changes describe reimbursement requirements for a program provider who purchases a wheeled mobility system for an individual or a major modification to a wheeled mobility system in compliance with Texas Human Resources Code, §32.0425.
