Public Notices
On May 14, 2009, at 1 p.m., the Texas Health and Human Services Commission (HHSC) will hold a public hearing on proposed payment rates for nursing facilities. The hearing will take place in the Permian Basin Room of the Health and Human Services Commission, Braker Center, Building H, located at 11209 Metric Blvd., Austin, Texas. HHSC will also hold hearings on proposed Medicare payment rates for several procedure codes: Implant Procedure Codes for Types of Service, Medicaid Vision Services Fees, Medicaid Molecular Lab Fees, Quarterly Medicaid Fee Reviews, Physician Evaluation & Management, and Durable Medical Equipment. The hearings will be held on May 12, 2009, at 1:30 p.m. in the Lone Star Conference Room of HHSC, Braker Center, Building H, located at 11209 Metric Boulevard, Austin. HHSC awarded a contract to The Paciello Group, LLC, which will review, replicate, and report on the plaintiff’s expert testimony regarding inaccessibility of the Access HR system application as detailed in the proposal and provide expert testimony at deposition and/or trial.
HHSC also announced the release of its Request for Proposals Number 529-09-0062 Independent Verification and Validation for Medicaid Eligibility and Health Information (EHI) Services, seeking a consultant to provide assistance by and through independent verification and validation technologies, techniques and methodologies associated with the Medicaid EHI Services project.

Proposed/Adopted Rule Reviews
The Texas Medical Board proposes to review Chapter 174, relating to Telemedicine, §§174.1 – 174.6, pursuant to the Texas Government Code, §2001.039. Read more here.
The Texas Medical Board adopts the review of Chapter 183, Acupuncture, §§183.1 – 183.23, pursuant to the Texas Government Code, §2001.039. The Texas Board of Nursing adopts the review of 22 TAC Chapter 214, Vocational Nurse Education; Chapter 215, Professional Nursing Education; and Chapter 222, Advanced Practice Nurses with Prescriptive Authority, pursuant to the requirements of the Government Code §2001.039. Proposed Rules
HHSC proposes to amend §355.110, Informal Reviews and Formal Appeals, and §355.111, Administrative Contract Violations, under Title 1 of the Texas Administrative Code (TAC), Part 15, Chapter 355, Subchapter A. The amendments would replace outdated references. For more information, see the relevant section of the Texas Register.
