Proposed Rules
HHSC proposed rules for several sections of the code:
Medicaid Managed Care – HHSC proposed to amend, repeal, and add new rules to several subsections to Chapter 353, Medicaid Managed Care. An excerpt:
The amendments and repeals are also proposed to delete references to the Integrated Care Management (ICM) program. ICM was a Texas Medicaid managed care program designed to address the care needs of people with disabilities or age 65 or older who lived in the Dallas and Tarrant service areas. The program was discontinued in February 2011 when the STAR+PLUS program expanded to those service areas, which made the ICM program obsolete. Therefore, HHSC is proposing to delete references to ICM.
Medicaid Health Services – HHSC proposed to amend §354.1189, Acute Care Medicaid Billing Coordination System; §354.1416, Eligibility Criteria for the Texas Medicaid Wellness Program; and §354.1417, definitions for the Texas Medicaid Wellness Program, to conform to proposed amendments and new rules in Chapter 353.
Hearings – HHSC proposed to amend §357.1, concerning definitions for its uniform fair hearing rules, to conform to proposed amendments and new rules in Chapter 353.
State Children’s Health Insurance Program – HHSC proposed to amend §§370.1, 370.4, and 370.10, Administration of CHIP; §370.21 And §370.49, Application Screening, Referral, Processing, Renewal, and Disenrollment; §§370.301, 370.303, 370.305, 370.307, 370.321, and 370.325, Enrollment, Disenrollment, and Renewal of Membership in CHIP; §370.452 and §370.454, CHIP Provider Requirements; and §§370.501, 370.502, 370.504, and 370.505, Special Investigative Units, to conform to proposed amendments and new rules in Chapter 353.

HHSC adopted amendments to §95.101, Introduction; §95.103, Requirements for Administering Medications; §95.105, Allowable and Prohibited Practices of a Permit Holder; §95.107, Training Requirements, Nursing Graduates, Reciprocity; §95.109, Application Procedures; §95.113, Determination of Eligibility; §95.115, Permit Renewal; §95.117, Changes; §95.119, Training Program Requirements; §95.123, Violations, Complaints, and Disciplinary Actions; §95.125, Requirements for Corrections Medication Aides; and §95.127, Application Processing. An excerpt:
The purpose of the adoption is to implement portions of Senate Bill (SB) 1, 82nd Legislature, First Called Session, 2011. SB 1 added Texas Human Resources Code §161.083 to require the executive commissioner of the Health and Human Services Commission to establish: 1) minimum requirements for the issuance, denial, renewal, suspension, and revocation of a permit for a corrections medication aide; 2) the acts and practices that are within the scope of a corrections medication aide permit; and 3) minimum standards and procedures for the approval of corrections medication aide training programs developed under Texas Government Code, §501.1485, Corrections Medication Aides, which was also added by SB 1.
